ATV CUSCO ADVENTURES ON WHEELS wants you to enjoy your vacation in Peru to the fullest, so we recommend that you carefully read and obey the instructions of your sales agent.
Please read the following conditions carefully, as it is your contract with ATV CUSCO ADVENTURES ON WHEELS, by booking a trip with ATV CUSCO ADVENTURES ON WHEELS you agree to be bound by these Terms and Conditions, which describe, among other things, our cancellation policy and certain limitations of liability at the time of making your reservation.
The appointment given by us will be valid once the reservation is confirmed, from which you will be able to ask all questions regarding your ATV vacation CUSCO ADVENTURES ON WHEELS will be happy to answer all questions for you. Quotes do not apply to international flights to and from Peru. If you want us to help you on international flights or within Peru, the flight must be paid immediately and purchased on the same day or, if possible, the next day to ensure the validity of the offer, since prices vary from one day to another. Unless we have made the quote already including airline tickets for national or international flights.
Our prices do not include meals not specified in your itinerary, personal expenses, personal insurance, and luggage transportation.

01. THE CONTRACT

The contract is between ATV CUSCO ADVENTURES ON WHEELS (also known as the company) and the client, who is the person traveling or attempting to travel on a tour operated by the company. You, the customer, are subject to having read and understood our travel policy as set out below. By making a reservation by telephone, through the website, or by email, you accept and are bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Company and the Client relating to the subject matter hereof, and shall constitute a binding agreement. There is no oral or written representation, warranty, warranty agreement, prior agreement, description of services, or conditions or any promise of refund other than as expressed herein. The service you must provide is/are the tour(s) mentioned in the booking confirmation.
These conditions only apply to the services in our program and not to international and domestic flights. These are subject to the conditions imposed by the airlines.

2. SECURING YOUR RESERVATION

To guarantee the reservation, ATV CUSCO ADVENTURES ON WHEELS requires a completed reservation form (either the one on our website or the one sent by us with your quote), along with the 40% deposit, which you can do in our COMPANY bank accounts (DOLLARS OR SOLS). The reasonable time to make your reservation is 90 business days before your trip to Peru, a reservation is accepted and becomes definitive only from the date on which your deposit is and at that time a contract exists. ATV CUSCO ADVENTURES ON WHEELS reserves the right to reject any reservation at its discretion.

3. CUSTOMER DATA

To confirm and guarantee the Clients the organization of the trip, the client must provide all their identity data with the initial payment or no later than 90 days before the start of the trip. Client details include DNI or passport number, copy of DNI or passport data and medical form (if applicable), full name, date of birth, international flight information and nationality, case or mobile phone number for any emergency.

4. FINAL PAYMENT / CHARGES

All our services and products offered ARE EXEMPT FROM THE PAYMENT OF VAT only for NATIONAL clients, which will be added to the total cost of each service you contract with us.
Foreign clients under D.L 919 do not pay the IGV tax.
In order for the company to confirm and guarantee Clients its organization of their trip, the client must provide all client details with their final balance at the start of the Tour.
Surcharges: To avoid surcharges on your vacation, make your reservation in advance, do not change hotels at the last minute.

The client may change or modify his reservation only before 90 days before his arrival at no cost. After 90 days, any modification or transfer, the client must pay 50% of the total reservation. All changes thereafter will be treated as cancellations and subject to charges as follows.
If a client is not able to travel, and informs us of his/her cancellation in advance, in circumstances that ATV CUSCO ADVENTURES ON WHEELS considers reasonable, then the reservation may be transferred to another suitable person, or his/her money will be returned less 35% of the amount. total of the reservation, since 15% goes to money transfer payments and the other 20% are administrative expenses, your money will be returned in less than 10 business days.

6. CHANGES

The company reserves the right to modify any of the facilities, services or prices described in the brochure or website. If this change is made, the client will be informed at the time of booking or when the change occurs. While the company will endeavor to operate all tours as advertised, reasonable changes to the itinerary may be made when deemed necessary or desirable by the Company due to external factors beyond the control of the company.

7. CANCELLATION BY THE COMPANY

ATV CUSCO ADVENTURES ON WHEELS. reserves the right to cancel any trip before performance is guaranteed, but will not cancel trip less than 20 days before departure. Your ride is guaranteed to work unless the minimum number indicates otherwise or due to factors beyond the control of ATV CUSCO ADVENTURES ON WHEELS. This applies to outputs within the brochure validity range.
Note: Airlines may impose 100% cancellation fees.
7. CANCELLATION BY THE CUSTOMER
ATV CUSCO ADVENTURES ON WHEELS. Reservations made by the client are subject to:
• Cancellation 60 days before, 50% of the deposited amount will be refunded, considering the expenses of the services purchased.
• Cancellation 30 days before, a refund of 25% of the deposited amount is made, considering expenses for the services purchased.
• Cancellation 15 days before, the company reserves rights to refund.

8. CLAIMS

If the client has a claim about any modification to their reservation, it is a condition of the contract to make the corresponding discharge at the time for immediate action to be taken by the company. If the claim is not made, ATV CUSCO ADVENTURES ON WHEELS. reserves the right to accept liability.
If the case in question could not be resolved in a timely manner, the client has the right to request the complaints book within 28 calendar days of their trip.

9. TRIP AND CANCELLATION INSURANCE

Travel insurance is highly recommended for all booking clients we recommend that it should cover personal injuries, medical expenses, repatriation costs, evacuation costs, cancellation and reduction. It is our policy to check the validity and coverage of your insurance policy and we reserve the right to deny transportation to anyone whose insurance does not meet these criteria. If you decide not to purchase travel insurance, you will be required to sign a waiver form acknowledging your acceptance that insurance is recommended but declined and should you need to change or cancel your trip or incur on expenses such as medical expenses, the client will be responsible for all such additional costs.

10. FINANCIAL SECURITY

ATV CUSCO ADVENTURES ON WHEELS., is a travel agency accredited by the Ministry of Tourism and registered as a public limited company of the Ministries of the Tourism Office of Peru. ATV CUSCO ADVENTURES ON WHEELS. complies with current European standards regarding the protection of client money.

11. CUSTOMERS RESPONSIBILITY

The client agrees to accept the authority and decisions of ATV CUSCO ADVENTURES ON WHEELS. employees, tour leaders and agents while on vacation. If in the opinion of these persons, the health or conduct of a client at any time, before or after departure appears to endanger the safety, comfort or tranquility of the tour, the client may be excluded from the entire tour. or part of the tour.
Clients must be in possession of their respective identity documents, and are responsible for carrying a valid passport, visa, if applicable, and the vaccination certificates required for the entirety of their trip. Your passport must be valid for 6 months after your return date.

12. OUR RESPONSIBILITIES

Reservations are accepted with the understanding that they appreciate the possible risks inherent in adventure travel and that they undertake the visits, excursions or expeditions, contained in our programs, at their own will. It’s also important to understand that the most meticulous arrangements can go wrong.
The company obliges to provide its services with the necessary diligence, so that the entire trip goes perfectly, we will strive to serve you as best as possible.
The Company assumes no responsibility for force majeure, weather events or natural phenomena that may occur before or during the trip, or for any eventuality that may make any trip uncomfortable or difficult, or for any delay or obstruction of your trip in any way. and does not guarantee failure on the part of the company, either for the total or partial execution of the provision of the services that the Company has agreed to provide which may have been affected by the aforementioned factors.

13. FLIGHTS / DELAYS

We cannot accept any responsibility for cancellations or delays on any of your flights, if the cancellation or delay is due to adverse weather conditions, rescheduling of the airline, airport authority and/or action of air traffic controllers, mechanical failure or industrial action.
Our company will make every effort to resolve your travel itinerary, and ensure that any inconvenience is resolved in the best possible way, considering change fees if the situation warrants it.
The Client must understand and be flexible if problems cannot be resolved due to air delays.
The company is not responsible for flight losses due to personal situations and/or decisions of the client.

14. POLICY ON CHILDREN

In all programs, unless otherwise indicated, the maximum age of a child is 6 years, over 7 years old are considered students, the maximum age of a student is 14 years and 11 months over 15 years old considered adults .

15. RESERVATION WITHOUT ADVANCE

For all reservations made within 30 days prior to the date of your trip, a differentiated rate will be considered to cover excess costs of services that are subject to availability. This Last Minute fee covers our additional costs for Hotel, Flight, Train Ticket, Bus Ticket providers and operating expenses.
